摘要

现阶段在我国,农村人口占全国人口的大多数,因此,村干部——村官是一个相当庞大的群体,他们拥有广泛的权力,管理农村的公共事务,并在一定范围内代替党委,政府行使国家的管理职权.然而,在目前依法行政的时代里,村官在行使职权的过程中,往往出现置法制于不顾的现象,职务犯罪时有发生,严重地影响了和谐社会的要求.农村基层组织成员作为一个新的犯罪主体,在管理集体经济时,利用职务之便,贪污,挪用公款,侵占集体资产,挪用集体资金,非法转让土地使用权等问题日益突出.由于此类犯罪呈多种形式,同时法律法规也存在一些盲点,使我们基层的办案人员在审理案件时遇到了定性,定罪难,取证难等问题.
为此,完善法制,预防村官的职务犯罪,健全村一级的基础行政体制,为顺利完成"十二五"乃至今后党的发展目标,打下深厚的群众基础.
